For insurance coverage disputes, see <strong><a href=\"https:\/\/kunstrecht-anwalt.com\/en\/art-insurance-law-germany\/\" data-type=\"page\" data-id=\"1327\">Art Insurance Law in Germany<\/a><\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Evidence Is Often Decisive in Art Litigation<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Successful litigation depends not only on the substantive legal position but also on whether the relevant facts can be proved.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is particularly important in art disputes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Whether a painting was created by a particular artist, whether it has been altered, when certain materials were first available, who owned the artwork at a particular time or when damage occurred cannot necessarily be established from legal documents alone.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on the case, evidence may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>purchase agreements and invoices,<\/li>\n\n\n\n<li>auction catalogues,<\/li>\n\n\n\n<li>certificates and expert opinions,<\/li>\n\n\n\n<li>catalogues raisonn\u00e9s,<\/li>\n\n\n\n<li>provenance documentation,<\/li>\n\n\n\n<li>historical photographs and correspondence,<\/li>\n\n\n\n<li>condition reports,<\/li>\n\n\n\n<li>scientific examinations,<\/li>\n\n\n\n<li>conservation reports,<\/li>\n\n\n\n<li>witness evidence, and<\/li>\n\n\n\n<li>court-appointed expert evidence.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">We therefore analyse the burden of allegation and proof at an early stage of a dispute and develop the litigation strategy accordingly.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Experts in German Art Litigation<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Expert evidence can be decisive in art litigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on the dispute, expertise may be required from art historians, provenance researchers, conservators, scientists, handwriting specialists, valuation experts or other specialists.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An important distinction must be made between an expert privately instructed by one of the parties and an expert appointed by the German court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under German civil procedure, the court generally selects the court-appointed expert and determines the questions on which expert evidence is to be taken.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This makes the procedural handling of expert evidence particularly important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The relevant factual propositions and questions for the expert should be identified carefully, and existing private expert evidence should be evaluated with a view to its potential use in litigation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Preserving Evidence Before Litigation<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In some art disputes, evidence should be secured before the artwork is restored, altered, transported or otherwise changes condition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">German civil procedure provides a specific procedure for the preservation and establishment of evidence known as the <strong>selbst\u00e4ndiges Beweisverfahren<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under \u00a7 485 ZPO, a court may, under specified circumstances, order an expert examination before the principal litigation. Where no lawsuit is pending, this can include establishing the condition or value of an object, the cause of damage or a defect, and the cost required to remedy it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This can be particularly relevant where:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>an artwork has been damaged and needs restoration,<\/li>\n\n\n\n<li>the cause of damage is disputed,<\/li>\n\n\n\n<li>the present condition must be documented,<\/li>\n\n\n\n<li>the amount of restoration work is disputed, or<\/li>\n\n\n\n<li>evidence may become more difficult to obtain later.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Evidence obtained through this procedure can subsequently be used in the main litigation under the conditions of \u00a7 493 ZPO.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For valuable artworks, the question of whether evidence should be preserved before restoration or other intervention should therefore be considered at an early stage.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Urgent Measures and Injunctions in Art Disputes<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Some art disputes require immediate action.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An artwork may be about to be sold at auction, transferred to another person, exported from Germany or otherwise placed beyond the claimant&#8217;s reach.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">German civil procedure provides mechanisms for interim legal protection. The appropriate remedy depends on the claim and circumstances of the individual case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An interim injunction may, for example, be available where a change in the existing situation could frustrate or substantially impede the enforcement of a party&#8217;s rights. \u00a7 935 ZPO expressly provides for interim relief in such circumstances. <a href=\"https:\/\/www.gesetze-im-internet.de\/zpo\/__935.html?utm_source=chatgpt.com\">Gesetze im Internet<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where urgent action may be necessary, legal advice should therefore be sought before the sale, transfer or movement of the artwork takes place.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Settlement or Litigation?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Not every art dispute should end in court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art litigation can be lengthy and expensive. In addition, public disputes concerning authenticity, attribution or provenance may themselves affect an artwork&#8217;s marketability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An early assessment should therefore consider not only the legal merits of the case but also its economic and strategic implications.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on the circumstances, a negotiated settlement may provide a more effective solution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, settlement is only appropriate where it adequately reflects the client&#8217;s legal and commercial position.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a satisfactory resolution cannot be achieved, we represent our clients before the competent German courts.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">International Art Disputes and German Courts<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The international nature of the art market means that disputes frequently involve several jurisdictions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A US collector may purchase a painting from a German dealer. A Swiss consignor may place an artwork with a German auction house. An artwork owned by a foreign collector may be damaged while on exhibition in Germany. The fact that an artwork is located in Germany does not by itself establish jurisdiction in every case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before commencing proceedings, it is therefore important to determine whether German courts have jurisdiction and which country&#8217;s law applies.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-base-color has-alpha-channel-opacity has-base-background-color has-background is-style-wide\" style=\"margin-top:var(--wp--preset--spacing--30);margin-bottom:var(--wp--preset--spacing--30)\"\/>\n\n\n\n<h3 class=\"wp-block-heading alignwide has-base-2-color has-text-color has-link-color wp-elements-4\">Do I need a German lawyer to litigate an art dispute in Germany?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In many significant art disputes, yes. Before the German Regional Courts (Landgerichte) and Higher Regional Courts (Oberlandesgerichte), parties must generally be represented by a lawyer. \u00a7 78 of the German Code of Civil Procedure (ZPO) provides for mandatory legal representation before these courts. <a href=\"https:\/\/www.gesetze-im-internet.de\/zpo\/__78.html?utm_source=chatgpt.com\">Gesetze im Internet<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Foreign clients can instruct German counsel directly. They do not need to appoint a lawyer in their home country merely because they live abroad. Much of the preparation and conduct of German civil litigation can be handled through German counsel, including correspondence with the opposing party, preparation of pleadings and communication with the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Whether the client&#8217;s personal attendance is necessary depends on the individual proceedings. A court may consider a party&#8217;s personal appearance appropriate, and evidentiary or procedural circumstances may make participation necessary or advisable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For international clients, we therefore assess at the outset which steps can be handled entirely through counsel and whether personal participation in Germany is likely to become necessary.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-base-color has-alpha-channel-opacity has-base-background-color has-background is-style-wide\" style=\"margin-top:var(--wp--preset--spacing--30);margin-bottom:var(--wp--preset--spacing--30)\"\/>\n\n\n\n<h3 class=\"wp-block-heading alignwide has-base-2-color has-text-color has-link-color wp-elements-6\">Who has to prove that an artwork is fake or misattributed?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The answer depends on the particular claim and the facts on which that claim is based.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In an authenticity dispute, the decisive legal question is therefore not simply whether one party believes that the artwork is genuine or fake. It must be determined which facts need to be established, which party bears the burden of proof for those facts and what admissible evidence is available.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Evidence may include contracts, invoices, auction catalogues, certificates, provenance records, catalogues raisonn\u00e9s, scientific examinations and expert opinions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If expert evidence is required during German court proceedings, the court generally selects and appoints the expert. This can be particularly important where restoration would alter the condition of the artwork and potentially destroy evidence relevant to a later dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">German civil procedure provides for an independent evidentiary proceeding known as the <strong>selbst\u00e4ndiges Beweisverfahren<\/strong>. Under \u00a7 485 ZPO, a court-appointed expert can, under the statutory conditions, establish matters such as the condition or value of an object, the cause of property damage or a defect and the cost of remedying that damage before the principal lawsuit has begun.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For a damaged artwork, this can be an important procedural tool. Before restoration begins, consideration should therefore be given to whether the current condition, cause of damage and required restoration measures should first be documented through appropriate expert evidence.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-base-color has-alpha-channel-opacity has-base-background-color has-background is-style-wide\" style=\"margin-top:var(--wp--preset--spacing--30);margin-bottom:var(--wp--preset--spacing--30)\"\/>\n\n\n\n<h3 class=\"wp-block-heading alignwide has-base-2-color has-text-color has-link-color wp-elements-8\">Can I stop an artwork from being sold or transferred while a dispute is pending?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Potentially. German civil procedure provides mechanisms for interim relief where urgent action is required.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under \u00a7 935 ZPO, an interim injunction may be available where a change in the existing situation could frustrate or substantially impede the enforcement of a party&#8217;s rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This can be relevant in art disputes if, for example, an artwork is about to be sold, transferred or otherwise placed beyond the claimant&#8217;s reach. Whether an injunction is available depends on the asserted right, urgency and the evidence available to establish the relevant circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where an auction or transfer is imminent, legal advice should therefore be obtained as early as possible.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-base-color has-alpha-channel-opacity has-base-background-color has-background is-style-wide\" style=\"margin-top:var(--wp--preset--spacing--30);margin-bottom:var(--wp--preset--spacing--30)\"\/>\n\n\n\n<h3 class=\"wp-block-heading alignwide has-base-2-color has-text-color has-link-color wp-elements-9\">Who pays the legal costs of an art lawsuit in Germany?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">German civil litigation generally follows the <strong>loser-pays principle<\/strong>. Under \u00a7 91 ZPO, the unsuccessful party must bear the costs of the litigation and reimburse the opponent&#8217;s necessary costs, including statutory lawyers&#8217; fees. If each party succeeds only in part, the costs can be divided proportionately.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Court fees and statutory lawyers&#8217; fees are generally linked to the value in dispute.
